Delivery times
• Standard (second class): 2-5 days from date of dispatch (allow 24 hours for dispatch)
• Express (first class): 1-2 days from date of dispatch (allow 24 hours for dispatch)

UK delivery options and charges
It usually takes around 24 hours to get your ordered item(s) ready to send. The delivery times given are from date of dispatch, not from when you place your order. For more information, please see our terms and conditions.

Can I change my delivery address after I've ordered?
Unfortunately once the order is placed and acknowledged you will be unable to change the delivery address. If your order has not been dispatched, you can cancel it and then place a new order for the correct delivery address. If you require assistance, please contact sales@nairnbookshop.co.uk

More delivery information
• We do not take any money from your card until your order is ready to send.
• Delivery is by Royal Mail or Parcelforce
• We are not able to deliver to airports.

Delivery to other countries
We use Royal Mail International Standard to deliver to overseas countries.  Please refer to 'Shipping Rates'  for details of cost.

Welcome to the The Nairn Bookshop website terms and conditions for use. These terms and conditions apply to the use of this website, and by accessing this website and/or placing an order you agree to be bound by these terms and conditions as set out below. If you do not agree to be bound by these terms and conditions you may not use or access this website.

Definitions
“Conditions” means these terms and conditions, “product” means a product displayed for sale on the website, “we, “us”, “our” means Mavis Macdonald t/a The Nairn Bookshop, “you”, “your” means the user of this website, “working days” means all days other than Saturdays, Sundays, and public holidays.
Use of website
Access
You are provided with access to this website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Registration
When you register with The Nairn Bookshop website, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.
You warrant that the personal information provided when you register as a customer is true, accurate, current and complete in all aspects, and you will notify us immediately if any of your details change, such as the credit card billing address. You may update your details by signing into your account on The Nairn Bookshop website.
You agree not to impersonate any other person or entity or to use a false name or a name you are not authorised to use.
Indemnity
You agree fully to indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, liability, damaged, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information.

Restrictions
By creating an account you confirm that you are aged 18 or over.
In placing an order you confirm that you are aware of any age restrictions on these products and assert that you are old enough to purchase them.
Certain products are subject to delivery restrictions. Some products can only be sent to UK addresses and can only be sent to a UK billing address. Where such restrictions apply these will be notified to you during the check out process.
In some instances we may decline to delivery parcels to PO addresses. We will contact you if we consider the delivery address provided to be a problem.

The contract between us
Your contract for purchases is with The Nairn Bookshop, 97 High Street, NAIRN, IV12 4DB. When placing an order, you agree that any and all information given is accurate and complete.
All orders are subject to acceptance and product availability.
If The Nairn Bookshop does not have enough stock to deliver the goods you have ordered, we will not charge your credit or debit card until the items are back in stock and ready to be dispatched.
No contract for the sale of any product will exist between you and The Nairn Bookshop until payment of the whole of the price for the goods ordered has been received. Payment is not taken until the point of dispatch of the goods to you. 
Once payment has been received The Nairn Bookshop will confirm that your order has been received by sending an email to you.
This confirmation email will be sent to the email address given in your order form and will detail products ordered, order number and the total price (including VAT and p&p).
The Nairn Bookshop acceptance of your order brings into existence a legally binding contract between us on these terms.
Any term sought to be imposed by you in your order will not form part of the contract.
You must check all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect.
If your order has not been accepted, you will receive an email from us telling you the reasons why.
The Nairn Bookshop is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website.
If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether. If we are unable to contact you or we receive no reply from you, we will cancel your order.
The Nairn Bookshop reserves the right to change prices listed without notice.
The Nairn Bookshop reserves the right to refuse to supply to any individual or company.

Withdrawal by you from the contract
If you are an individual and are not buying goods on behalf of a business, there are certain circumstances in which you may withdraw from the contract and these are set out here. This right to withdraw does not apply to business buyers.
• You may withdraw your order for goods at any time up to the end of the twenty first working day after you have received the goods. You do no need to give The Nairn Bookshop any reason for withdrawing your order nor will you have to pay any penalty.
• The only circumstances in which you cannot withdraw your order is where you have taken the goods you have ordered (or the ones in relation to which you want to withdraw) out of the sealed package in which they were delivered. 
• To withdraw your order you must notify The Nairn Bookshop in writing at the address set out in the Returns section of this website
• If you have received the goods before you withdraw your order, then you must send them back to The Nairn Bookshop return address at your own cost and risk, unless the goods were supplied faulty or damaged. If you withdraw your order but The Nairn Bookshop has already processed the goods for dispatch and you have yet to receive them, you must not unpack the goods when they are received by you and you must send the goods back to The Nairn Bookshop return address at your own cost and risk as soon as possible.
• Once you have notified The Nairn Bookshop that you are withdrawing your order, any sum debited to The Nairn Bookshop from your credit/debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order.

Availability of goods you order
If The Nairn Bookshop has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by The Nairn Bookshop from your credit/debit card will be re-credited to your account and The Nairn Bookshop will notify you by email at the address given by you on your order form. The refund will be made as soon as possible and in any event within 30 days of your order. The Nairn Bookshop will not be obliged to offer any additional compensation for disappointment suffered.
We will take all reasonable care to ensure that all details and availabilities of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up-to-date as possible, the information including product descriptions, prices and availability at a particular time may not reflect the position exactly at the moment you place an order. Please note that the price the goods are offered for tender are as displayed in the shopping basket. Your credit/debit card will only be debited as your order or individual items within your order are dispatched.

Multi-buy offers
Prices exclude postage and packing. Promotions apply to listed products only, which are subject to change and availability. If you choose to purchase a product from a multi-buy offer, but do not purchase enough products to qualify for the special discount, the product will be charged at the normal price. Please note that on 3 for 2 promotions (and other multi-buy offers), the lowest priced title will always be the ‘free’ item.
Should a multi-buy item be cancelled from your order, the total cost of the order will be recalculated to reflect that your purchase no longer qualifies for the multi-buy discount.

Delivery of goods to you
The delivery period stated within which you will receive your order is approximate based upon availability, normal processing and delivery companies.
Goods will be sent to the person and the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in installments if certain items are out of stock.
If your delivery address is outside of the UK, you may have to pay import duties and taxes, which are levied once a shipment reaches your country. You must meet any additional charges for customs clearance.
It is accepted by you that The Nairn Bookshop  has no control over additional charges in relation to customs clearance.
Please note, customs policies vary widely from country to country. We recommend you contact your local customs office for further information.
Please note international shipments may be subject to cross-border inspections by customs authorities.
You will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution centre.
Payment
The Nairn Bookshop uses Paypal to accept payments. 
Before accepting your order Paypal will carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to cover the cost of the transaction. No payment is debited from your card during this pre-authorisation, though your card issuer may ‘reserve’ these funds against your payment card.
Your payment card will only be charged when the items in your order are ready to be dispatched.
All product prices and delivery charges are shown in UK pounds sterling.
Prices and VAT
Prices shown on the website include VAT, where and to the extent that VAT is required to be applied to the product under UK VAT law.
Delivery charges are extra and are applied where applicable.
Although we make every effort to ensure the prices on the website are correct, mistakes may sometimes be made. If we discover a mistake in the price of the products you have ordered prior to their dispatch, we will contact you and give you the option of either reconfirming your order at the correct price or cancelling your order. If we do not receive a reply we will cancel your order. The Nairn Bookshop will not be obliged to offer any compensation for disappointment suffered.

 

Compliance with laws 
The website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the website and any transactions conducted on or through the website.

 

 

Intellectual property and right to use 
You acknowledge and agree that all copyright, trademarks and all other intellectual property in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only and that you may (if necessary to make a purchase) download such material and content only onto one computer hard drive for such purpose. Any other use of the material and content of the website is strictly prohibited. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website.

This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights. The nature of internet communications means that your communications may be susceptible to data corruption, interception and delays.
We shall not be responsible for any detrimental reliance you place on this website or its contents.

 

 

Severance 
If any part of the conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the conditions and shall not affect the validity and enforceability of any of the remaining provisions of the conditions.

 

 

Waiver No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision

 

 

Survival 
Each provision of the conditions shall be construed as separately applying and surviving even if for any reason or other of those provision is held to be inapplicable or unenforceable in any circumstances.

Our website may contain hyperlinks. These hyperlinks connect you to sites of other organisations which are not our responsibility. We have no control over any of the information you can access via other websites. Force majeure 
The Nairn Bookshop shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstances beyond its reasonable control.

 

 

Entire Agreement
These terms and conditions, together with the current Nairn Bookshop website prices, delivery details and The Nairn Bookshop’s contact details, set out the whole of our agreement relating to the supply of the goods to you by The Nairn Bookshop. Any changes to these conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what The Nairn Bookshop and you are expected to do. You confirm that, in agreeing to accept the conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these conditions and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions. Nothing in this clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the conditions.

 

 

Law & Jurisdiction
The terms and conditions shall be governed by and construed in accordance with the laws of Scotland and any disputes will be decided only by the Scottish Courts. .

 

 

Variation of Terms and Conditions
We have the right to vary these terms and conditions from time to time but you will only be subject to the terms that applied when you placed the order with us unless the changes are the result of changes to the law having retrospectively effect or we notify you of the changes before dispatch of your order in which case unless you notify us to the contrary within 7 days of receipt of notice of the change we can assume that the changes are acceptable.
